Intro:

The Blackhawk Saloon opened for business Friday evening after temporarily losing its liquor license Monday for repeatedly violating the Kanawha-Charleston Health Department's indoor smoking ban.

Kerry "Paco" Ellison, who owns the Charleston-area bar, was told he had violated the smoking ban and was allowing criminal activity to take place in his establishment by letting patrons and bar employees smoke. As a result, the state Alcohol Beverage Control Administration pulled his license until an agreement could be reached.

Ellison said that he'd pay the hefty fine -- equal to what he pays to have a liquor license in the first place -- to get his papers and license back.

Ellison will be required to pay a $1,000 fine in four monthly payments to the ABCA in addition to posting non-smoking signs and removing all ashtrays and other smoking paraphernalia from the bar, said ABCA spokesperson Gig Robinson. . . .

"I signed the agreement saying I'll be a good boy from now on," he said.
