Intro:

The Cornell Law School Web site lists numerous court cases and citations of the Americans With Disabilities Act which thoroughly debunk the myth that employers are required to accommodate smokers, public smoking ban or not. To that end, employers can actually dictate what can or cannot be done on break or meal periods because you still have a shift to finish for that day. . . .

If employees want to throw a fit and quit because of not being allowed to smoke, then they can go work at a place like Wal-Mart, which provides a separate smoking room for employees on their break and meal periods and allows workers to smoke outside on said breaks. If you can't handle working for a company whose rules infringe upon a nonexistent right, then get another job. It is not legally obligated to allow you to smoke on its premises.
