Broome County has issued its first fine for repeated violations of the state's 5-month-old smoking ban. Another 17 bars and restaurants have been sent final warning letters, the county Health Department said.

Curtis D. Decker of Hallstead, Pa., owner of the East Side Tavern, 228 Robinson St., Binghamton, said he hasn't decided whether to pay the fine or challenge the citation issued Dec. 3.

Decker had until Saturday to pay a reduced, $500 fine if he signed a statement agreeing he would comply with the smoking ban. . .

Broome County Environmental Health Division Director Robert Denz said Friday his office has put another 17 bars and restaurants on formal notice that health inspectors found smoking inside their businesses despite earlier warnings. . . .
