Intro: The leisure industry has been warned to gear up for a wave of lawsuits if they do not address the issue of staff and customers smoking in the workplace. This warning comes following the recently reported 50,000 out of court settlement which Michael Dunn, a casino worker in central London, reached with his employer following his claim that he had developed asthma due to passive smoking at work.
Now is a good time to take a look at the exposure to liability from employee claims if employers fail to take action on the issue of smoking in the work place. . . .
Considering the fact that compensation for unfair dismissal awards could reach 50,000 in the employment tribunal, employers, even in workplaces where employees are traditionally exposed to smoke (like pubs and clubs), are well advised to enter into an active consultation with their employees to discuss measures which could be implemented to accommodate non-smoking employees.
