Intro: Louisville, Kentucky-based Brown & Williamson had challenged
the Carter verdict by arguing that the statute of limitations on
the smoker's rights to sue over injuries had elapsed.
A three-member panel of Florida's First District Court of
Appeal in Tallahassee agreed. ``The initial complaint was filed
more than four years after Grady Carter knew or should have
known, with the exercise of due diligence, that he had a smoking-
related disease,'' last June's ruling said.
