Intro: City Clerk Gina Dutcher has certified about two-thirds of the 3,321 signatures needed to suspend the smoking ban and force City Council to repeal it or refer it to voters.
The smoking ban is still in effect and will be until Dutcher certifies that the referendum petition has at least 3,321 valid signatures. . .
It appears likely there will be enough valid signatures because Dutcher's staff has checked only 99 of the 327 pages of the petitions submitted by Puebloans For Common Sense in Government. . .
The smoking ban will be suspended as soon as Dutcher's staff has certified 3,321 signatures, according to City Attorney Tom Jagger.
After that, City Council must decide whether to repeal the ban entirely or let voters decide if they want it. The only way council can make any changes to the present ban is to repeal it and enact a new smoking ordinance, Jagger said.
Council members appear ready to let voters decide the question. The issue could go to a special election or be decided at the next general election in November.
