Claymont, Delaware, man takes first smoking fine

A Claymont restaurant owner engaged in a battle of wills with state officials received the first fine under Delaware's tough new indoor-smoking ban Monday.

"I'm proud," said a defiant Omar Semiz, owner of the Coach House Restaurant.

Mr. Semiz has 30 days to pay the $100 fine; failing to do so could result in a possible criminal charge of failure to comply with an administrative order.

"I'll see what my lawyer says and take it from there," he said.

State officials say Mr. Semiz's contention that his restaurant is now a private club exempt from the nation's toughest ban on indoor smoking is just a sham.
