Cigarette company says lawsuit is invalid 

In her lawsuit, Catherine S. Marrone argued that the company fraudulently marketed Virginia Slims Lights cigarettes as being low in tar and nicotine. She contends the company knew the cigarettes were actually designed to deliver more tar and nicotine. . .

Attorney Diane Chapman, who represents Philip Morris, told Medina County Common Pleas Judge James L. Kimbler that the case should be dismissed. She contended that an Ohio consumer law requires that a court or the attorney general must have found that a fraudulent practice has taken place before a class-action suit can be brought.
