Intro:

A Wichita lawyer is challenging a provision in the recent tobacco settlement that prevents the public from knowing how much lawyers hired by the state are paid.

Gerald Michaud, a nationally known medical-malpractice attorney, filed a motion in Shawnee County District Court on Monday, asking the court to appoint a special master for a public review of the state-hired lawyers' fees.

The two-page motion also asks the court to order the lawyers to disclose their expenses.

Gov. Bill Graves says he is not going to spend any money from the state's estimated $1.5 billion settlement with the tobacco companies until the money actually gets here.

The governor also said during an interview in his office Wednesday he fears the federal government may try to get 60 percent of the state's share of the tobacco settlement money.
